Urgent Call from lawyer Mohammad Mostafaei

A Call for Saving Children's Lives on Death Row

I never thought Behnoud Shojaee would be executed, considering that in the presence of a number of popular activist artists, the family of his victim agreed to forgive him. Even in a confidential meeting, they said they would settle for
"Diyya" (Blood money). Since Behnoud’s family is not financially well-off, the artists opened an account to raise money to help with the payment. After opening the account, a public announcement was made in the print media that mentioned Behnoud’s name. The family became upset at this and retracted their initial consent.

The family decided that their initial forgiveness was no longer acceptable; and our pleading didn’t go anywhere. On October 11, 2009, Behnoud went to the gallows and was executed.

Currently, several clients of mine who were under 18 when they committed their crime are awaiting execution. There is an urgent need to collect blood money for them so that we can get the money to the victim's family for consent or forgiveness. Because the matter is extremely sensitive, I cannot release the names of my clients, but once blood money is collected and a family’s consent is obtained, they will be released.

In order to obtain consent from a victim’s family, there is a need for money to be paid to the family at the time of their forgiveness. I was forced to open an account that would help save lives of offenders who were minors at the time of their crime. I say I was "forced," because I just could not find any other organization or group that I could trust with this matter.

In December 2003, a bill to raise the minimum age to 18 was approved by the parliament, but must still receive the approval of the highest governing body in Iran, the Guardian Council, to become law.
Although Iran is a state party to the Convention on the Rights of the Child, that forbid them to execute anyone who has allegedly committed an offence before the age of 18, they are the biggest executioners of Juveniles.

China

For example, in 1997, China amended its Criminal Code to ban executions of persons under 18 at the time of the crime. Despite this advance, in January 2003 China executed Zhao Lin, who was reported to be 16 at the time of the offense, and on March 8, 2004 executed Gao Pan, who is believed to have been 16 or 17 at the time of the offense. Human Rights Watch has received no further evidence of death sentences against juvenile offenders.

China revised a law in 1997 forbidding the execution of defendants under age 18 at the time of the crime, but juveniles continue to be executed due to insufficient care in determining the age of defendants.

Nigeria

As of February 2008, 725 men and 11 women were on death row in Nigeria. At least 40 of them were under 18. About 53 percent were convicted of murder. Most of the rest were convicted of armed robbery and robbery.
